Bankruptcy law is federal law. If you reside in the counties of Pinellas, Pasco, Hernando, Hillsborough, Polk or Manatee, your bankruptcy petition will be filed in the United States District Court, Middle District of Florida, Tampa Division. All attorneys admitted to practice before the bankruptcy court must file their clients’ petitions electronically. A judge and applicable trustee are randomly assigned when the case is filed. Between 20 and 40 days after date of filing, the statutory meeting of creditors will be held in the Timberlake Annex on Polk Street, a federal building located diagonally across from the United States Federal Court complex on North Florida Avenue in downtown Tampa. A bankruptcy trustee will preside over this meeting.
A United States bankruptcy judge will adjudicate your case. There are five federal judges assigned to the Tampa Division, two standing Chapter 13 trustees and approximately 15 panel Chapter 7 trustees.
Since 1997, it has been my privilege to undertake bankruptcy work in the Tampa Bay area, from which time it has constituted 95% of my practice. On the basis of this experience, allow me to assure you: professionalism in this district is set to a high standard. Much will be expected from you, but you will be treated fairly.
